II. GENERAL INFORMATION ABOUT THE COLLECTION AND PROCESSING OF YOUR DATA
1. scope of processing
As a matter of principle, we process personal data only to the extent necessary to provide a functional website and our content and services. Personal data is regularly processed only with consent. An exception applies to cases in which prior consent cannot be obtained for factual reasons and the processing of the data is permitted by law.

Your data is processed either on the basis of your consent or if the processing is necessary for the performance of a contract to which you are a party, or for the implementation of measures taken at your request prior to the conclusion of a contract, or on the basis of a legitimate interest, cf. Art. 6(1)(a)-(b), (f).
If the processing is based on your consent, you can withdraw your consent at any time by contacting us using the contact details in clause 1.
3. storage and deletion of your data
We generally store personal data only for as long as is necessary to fulfill the contractual or legal obligations for which we collected the data. Thereafter, we delete the data immediately, unless we still need the data until the expiry of the statutory limitation period for evidence purposes for claims under civil law or due to statutory retention obligations.
We delete or block the personal data of the data subject as soon as the purpose of the storage has been fulfilled. Storage may also take place if this has been provided for by European or national legislators in Union regulations, laws or other provisions to which our company is subject (see sections 3.1-3.3 for details). Data will also be blocked or deleted if a storage period prescribed by the aforementioned standards expires, unless there is a need to continue storing the data for the conclusion or fulfillment of a contract.
3.1 Storage of data
Due to tax regulations, account data will be retained for up to five full tax years after termination of your PMDeers account.
Configuration data and system generated data will be deleted immediately when you terminate your PMDeers account.
End user data will be deleted consecutively after 12 months from registration, and immediately if you terminate your PMDeers account.
3.2 Retention of data to comply with legal requirements.
You may not request PMDeers to change the default retention periods, except for the reasons for deletion under clause 3.3, but you may propose changes to comply with certain sectoral laws and regulations.
3.3 Return and/or deletion of data
With the exception of account data, no data will be retained after termination of the Agreement. You may request a copy of data prior to termination. You may not terminate the PMDeers account before the data copy has been delivered or PMDeers will not be able to deliver the data copy.
III. PROVISION OF THE WEBSITE AND CREATION OF LOG FILES

1.5. To provide you with the opportunity to speak with an expert.

2.1 Each time you access our website, our system automatically collects data and information from the computer system of the calling computer. This includes information such as
- Information about the type and version of your internet browser,
- The operating system of your computer or smartphone,
- Your Internet service provider,
- your IP address,
- Date and time of your access,
- Geographic location,
- Websites from which you came to us,
- Websites you visit from our website;
We collect this technical information in so-called "log files" so that you can view our website correctly and we can determine the causes of any technical problems, for the technical optimization of our websites and for the purpose of security of our computer systems and networks. The legal basis for these purposes is the legitimate interest in processing the data pursuant to Art. 6(1)(f).
The data is deleted as soon as it is no longer necessary for the purpose for which it was collected. As a rule, this technical information is deleted or made unrecognizable after seven days at the latest.
The collection of the data for the provision of the website and the storage of the data in log files is essential for the operation of the website.
2.2 Each time you use our service to scan your website, your e-mail address and the definitions of the cookies found when the service scans your website(s) are processed, including reports on the result of each scan.
IV. CONTACT REQUESTS FOR PRODUCT INFORMATION, A DEMO OR OTHER CONCERNS

On our website you can contact us through various options: e.g. book a demo, request a quote, request product information, request instructions, contact request form, support tickets. If you make use of these options, the data entered in the input mask will be transmitted to us and stored. In addition to the specific data in the input mask, the IP address as well as the date and time of the request are also collected and stored.
Alternatively, it is also possible to contact us via e-mail address. In this case, your personal data transmitted by e-mail will be stored.
In this context, the data will not be passed on to third parties unless this is necessary for processing the request (e.g. demo booking tool). In any case, the data will be used exclusively for processing the conversation, unless otherwise agreed.

The processing of personal data from the input mask is solely for the purpose of processing your request.
4. duration of storage
If you have booked a demo, requested product information or a quote, we reserve the right to store the data for two years to measure the profitability of our sales and marketing. Otherwise, we delete the data as soon as it is no longer necessary to achieve the purpose for which it was collected. For the personal data that you entered in the contact form and that was sent by e-mail, this is the case when the respective conversation with you has ended. The conversation is ended when it is clear from the circumstances that the matter in question has been conclusively clarified.
5. revocation of consent and possibility of deletion
You have the option to revoke your consent to the processing of personal data at any time. If you contact us by e-mail, you can object to the storage of your personal data at any time. In such a case, the conversation cannot be continued. All personal data stored in the course of contacting us will be deleted in this case.
V. NEWSLETTER
When registering for the newsletter, the data entered in the input mask is also stored in order to provide the newsletter. The legal basis for this processing is GDPR Art. 6(1)(a). Your e-mail address, the time of registration and the IP address used for registration will be stored for as long as you subscribe to our newsletter. This service is provided via a double opt-in process. You will then receive an email with a link to confirm that you are the owner of the email address provided and wish to be notified of our email service. You may unsubscribe from this service at any time by clicking on the link provided in each newsletter.
You will be notified by PMDeers via email of relevant changes affecting the Service, such as the implementation of additional features, if you subscribe to PMDeers' newsletter.
VI. YOU BECOME A CUSTOMER OR PARTNER OF PMDEERS
1. scope of data processing
You may become a customer or partner of PMDeers. Any information we collect from you may be used for one or more of the following purposes:
1.1 To enable you to control the user experience towards end users and enable the Service to automatically transfer end user consent to other websites of yours;
1.2 To identify you as a contracting party;
1.3 To provide you with a secure login to the Service Manager on PMDeers.ch;
1.4 To establish a primary communication channel with you;
1.5 To enable PMDeers to issue valid VAT invoices and process transactions (your data will not be sold, exchanged, transferred or disclosed to any other company, for any reason, without your consent, except for the express purpose of providing the requested service);
1.6 To enable the automatic processing of subscriptions;
1.7 To create and display cookie statements for end users and to store and display scan reports for you;
1.8 To provide you with aggregated information about End Users' decisions regarding the types of cookies accepted and to create a graphical representation in the Service Manager; and/or
1.9 To send you periodic emails [the email address you provide for order processing may be used to send you information and updates related to your order, in addition to occasionally receiving company news (if accepted), updates, information about related products or services, etc.].
If at any time you wish to unsubscribe from receiving future emails, you may delete your account after logging in by clicking "Delete My Account".
2. processed data
When you register on our website and become a customer or affiliate, four categories of data are processed about you and on your behalf:
"Account Data"
When you register for an account on our website, place an order, subscribe to our newsletter, or participate in a survey, basic contact information is collected, such as your contact email address and name, company name, address, phone number, VAT number, preferred language and currency, any order numbers, any email addresses of invoice recipients, and masked credit card or bank account information.
"Configuration Data."
We collect your direct inputs to our PMDeers cloud service (the "Service") after you sign up, such as the domain name(s) of the website(s) on which you implement the Service and the configuration of its content, appearance and behavior to website visitors ("End Users").
"System Generated Data".
The Service automatically creates and stores metadata based on other types of data, such as:
When you become a customer, subscription data, such as start date, last invoice date and the result of a mandatory VAT number check. Issued invoices are stored so that you can access all issued invoices from Service Manager.
If you sign up for a PMDeers account, your user behavior will not be evaluated by PMDeers.
3. legal basis for processing
The legal basis for the processing of data, if consent is given, is GDPR Art. 6(1)(a). When registering for a PMDeers account, the legal basis is GDPR art. 6(1)(b) for the performance of a contract or the implementation of pre-contractual measures.
4. purpose of data processing
The registration is necessary for the fulfillment of the customer or partner contract or for the implementation of pre-contractual measures.
5. possibility of objection and elimination
You have the option to delete your account at any time. You can change the data stored about you at any time. Insofar as the data is required for the fulfillment of a contract or for the implementation of pre-contractual measures, early deletion of the data is only possible insofar as contractual or legal obligations do not prevent deletion.

At PMDeers, we value your privacy, so we have taken the necessary precautions to comply with the California Consumer Privacy Act (CCPA). For visitors coming from California, the CCPA applies. You may object to the processing of your data at any time with effect for the future. In addition, you may exercise your rights under the CCPA by contacting us at privacy@PMDeers.ch.
IX. MINORS
Our Services are not directed to children under the age of 15. We do not knowingly collect information from children under the age of 15. If you are under this age limit, do not use the Services or provide us with any Personal Information. If you are the parent of a child who has not yet reached the age limit and you learn that your child has provided PMDeers with Personal Data, please contact privacy@PMDeers.ch and insist on exercising your rights of access, rectification, deletion and/or opposition. If you are a California resident under the age of 18 and wish to delete publicly available content, please contact us at privacy@PMDeers.ch.
X. ONLINE PRESENCE ON SOCIAL NETWORKS
We maintain online presences in social networks in order to communicate there with customers and interested parties, among other things, and to provide information about our products and services.
User data is generally processed by the social networks concerned for market research and advertising purposes. In this way, usage profiles can be created that are based on the interests of the users. For this purpose, cookies and other identifiers are stored on the users' computers. Based on these usage profiles, advertising is then placed within the social networks, for example, but also on third-party websites.
As part of the operation of our online presences, it is possible that we can access information such as statistics on the use of our online presences provided by the social networks. These statistics are aggregated and may include, in particular, demographic information and data about interaction with our online presences and the posts and content distributed through them. The legal basis for the data processing is GDPR Art. 6(1)(a)-(b), in order to stay in contact with our customers, to inform them and to carry out pre-contractual measures with future customers and prospects.

We would like to point out that data protection concerns can be asserted most efficiently with the respective provider of the social network, as only these providers have access to the data and can take appropriate measures directly. Google My Business
We operate a so-called Google My Business entry. Should you find us this way, we use the information service of Google and the services of Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland (hereinafter "Google").
We would like to point out that you use the Google site and its functions on your own responsibility. This applies in particular to the use of the social and interactive functions (e.g. commenting, sharing, rating, direct messaging). When you visit and interact with our Google My Business listing, Google also collects your IP address and other information located on your terminal device in the form of so-called cookies. This information is used to provide us, as the operator of the Google My Business listing, with statistical information about the use of Google services. The data collected about you in this context is processed by Google and may be transferred to countries outside the European Union. Google generally describes in its privacy policy what information it receives and how it is used. Google provides more detailed information in its privacy policy:
Google Privacy Policy
We do not know how Google uses the data from the visit for its own purposes, to what extent activities of individual users are assigned, how long Google stores this data and whether data is passed on to third parties. When you access Google services, the IP address assigned to your terminal device is transmitted to Google. Google also stores information about the end devices of its users; this may enable Google to assign IP addresses to individual users or user accounts.
If you contact us via direct message through our Google My Business entry or other Google services, we cannot rule out the possibility that these messages will also be read and evaluated by Google (both by employees and automatically). We therefore advise against providing us with personal data there. Instead, another form of communication should be chosen as early as possible. We delete conversations no later than 14 days after the last chat activity or immediately after switching to another communication channel. The use of this service is subject to Google's privacy policy, which you - by using it - have already agreed to.
We, as the provider of our Google My Business entry, do not collect and process any further data from your use of this Google service. Beyond that, we do not use any Google functions on our website.
XI. LINKS TO THIRD PARTY PROVIDERS
Occasionally, at our discretion, we may include or offer third party products or services on our website. These third-party websites have separate, independent privacy policies. We therefore assume no responsibility or liability for the content or activities of these linked websites. Nonetheless, we are committed to protecting the integrity of our website and welcome any feedback regarding these websites.
XII. RECIPIENTS OF DATA AND DATA TRANSFER TO THIRD COUNTRIES
12.1 Recipients of Data
PMDeers does not sell, trade, or otherwise disclose personal data to third parties.
This does not include trusted third parties or processors who assist us in operating our website, conducting our business, or providing services to you. Such trusted parties may have access to personally identifiable information on a need-to-know basis and are contractually obligated to keep your information confidential.
We may also release your information when we believe release is appropriate to comply with the law, enforce our site policies, or protect our rights or the rights of others, property, or safety. In addition, non-personally identifiable visitor information may be shared with other parties for marketing, advertising, or other purposes.
We only share the data we collect if it is necessary to fulfill a contract or to provide the technical functionality of the website, or if there is another legal basis for sharing.
In principle, we process your data ourselves. In some cases, however, we also use service providers. In addition to the processors mentioned in this privacy policy, these may include, in particular, data centers that store our website and databases, IT service providers that maintain our systems, and consulting companies. If we pass on data to order processors, they may only use the data to perform their tasks. The processors have been carefully selected and commissioned by us. They are contractually bound to our instructions, have appropriate technical and organizational measures in place to protect the rights of data subjects, and are regularly monitored by us.
In addition, disclosure may be made in connection with official investigations, court orders and legal proceedings if this is necessary for legal prosecution or enforcement. When governments make a lawful request for PMDeers' customer data, PMDeers will endeavor to limit disclosure. PMDeers will only release data that is required by the relevant legal request.
If PMDeers is required to disclose your information, it will promptly notify you and provide you with a copy of the request, unless prohibited by law.
If PMDeers commissions third parties with the collection, processing and use of data as part of a commissioned processing pursuant to Art. 28 DSGVO, this will also be done exclusively in compliance with the legal provisions on data protection.
12.2 Data transfer to third countries
As explained in this Privacy Policy, we use services whose providers are partly located in so-called third countries (outside the European Union or the European Economic Area) or process personal data there, i.e. in countries whose level of data protection does not correspond to that of the European Union. Where this is the case and the European Commission has not issued an adequacy decision (Art. 45 GDPR) for these countries, we have taken appropriate precautions to ensure an adequate level of data protection for any data transfers. These include, among others, the standard contractual clauses of the European Union or binding internal data protection regulations.
If a transfer to a third country is planned and there is no adequacy decision or suitable guarantees, there is the possibility and risk that authorities of the respective third country (e.g. intelligence services) may gain access to the transferred data in order to collect and evaluate it, and that the enforcement of your data subject rights is not guaranteed.

XIII. YOUR RIGHTS
If we process your personal data, you have - after successful identification - the following rights towards us:

Right to data portability (Article 20 GDPR) - you can request a full copy of your data at any time, which you can transfer to another controller. Your data will be delivered by PMDeers within 10 working days in the form of spreadsheet files in Microsoft Excel format. Logical relationships between records will be maintained in the form of unique identifiers. For each order of a copy of data, you must pay €1,000 (one thousand euros) and all applicable taxes upon delivery.
Right to withdraw consent (Article 7(3) GDPR).

You may lodge a complaint with a supervisory authority about the collection and processing of your personal data by PMDeers at any time. In Switzerland, you may file a complaint with the Swiss Data Protection Authority.
XIV. SECURITY AND INTEGRITY OF DATA
Protecting the information you give us or that we receive about you is a priority for us. We take reasonable security measures to protect your information from loss, misuse and unauthorized access, alteration, disclosure or destruction. PMDeers has taken measures to ensure the continued confidentiality, integrity, availability and resilience of systems and services that process personal information and will restore availability and access to information in a timely manner in the event of a physical or technical incident.
